He deserves to be elevated, and perhaps, there has been discrimination with the competent Muslim judges from Kashmir happening for decades who never made it to the Supreme Court while there have been few of their counterparts from Jammu who retired as judges of the apex court. It is not something that Kashmir does not have the qualified people who could be elevated to the highest position, but the Government has not been quite willing to go ahead with that: something that can be substantiated by the history spanning over last several decades which didn’t see a single judge from Kashmir witnessing an elevation to the highest post in the Judiciary; something that needs to change now, and forever.
If the Government is willing to make a difference, now is the best opportunity for it to do that by appointing Justice Magrey as the Supreme Court judge because no matter the President makes the appointment, the advice for the same goes from the Government. More so, if, what we are pitching for here, happens, then it will strengthen the connect of the Valley with the Union of India further, and the Government would be able to make it a point that it has been able to do away with the discrimination which Kashmir faced concerning the highest-level appointments, in this case, Judiciary.
It must be noted that the various organs of the system contribute to a greater sense of belonging by integrating individuals from various groups, allowing them to become a part of it, and having them work for the benefit of not only that specific organ, not only the system but also of the entire country. The inherent ability of the system to keep everything glued, in contact with one another, needs to be further explored, and fine-tuned; more and more Muslim judges need to be seen in the SC, starting with having deserving ones from Kashmir and moving forward with the elevation of Justice Magrey because, as the face of the judicial system in J&K, particularly Kashmir, taking him to the apex court to discharge his services, would be a great move from the Government, which it must go for.
